ofsale's terms for Solo shops
Version 2026-10-22b, in effect from 22 October 2026.
Interim terms. These are plain-language terms for ofsale's invitation-only early
access. They will be replaced by terms reviewed by an attorney. You'll see the new terms before
they apply to you, and if you don't agree you can close your shop and take your data with you.
Who we are
ofsale is software for selling secondhand, vintage and antique pieces: tags, a register, an
online shop page and the tools around them. In these terms "ofsale", "we" and "us" mean the people
who run ofsale, and "you" means the person who makes a Solo shop.
What Solo is
- Solo is a free ofsale shop for one person. It has one owner and no staff or vendors. One
device at a time can be its register; pairing a new device unpairs the old one.
- Solo holds up to 200 pieces at home (pieces in stock that aren't in a booth
at another store) or 200 sales a month, whichever comes first. A piece marked
sold or taken out of stock counts like a sale. Deleting a piece that was never shown to the public
and never sold doesn't count. The month is your shop's calendar month.
- At a limit, you can't add more pieces until there's room again (a piece sells, moves to a
booth or a new month starts) or you choose a paid plan. A sale is never refused
because of a limit.
- Solo is free. ofsale takes no cut of your sales. AI features (such as writing a piece's
description from its photos) are paid for from a prepaid balance you choose to add; you see the
price before you buy. Paid plans are optional, and nothing is charged unless you agree to it.
- Your shop may go to sleep when nobody is using it. The first visit after a quiet spell can
take a few seconds while it wakes.
- Solo is meant for one person selling on their own. One person or business gets one Solo
shop, and one card-payment account can be connected to only one Solo shop. If a shop looks like
part of a bigger store, we may ask you to move to a plan that fits.
Your account
- You must be at least 18 and able to make a contract.
- Your shop signs you in with a passkey that lives on your phone or computer. Its private key
never leaves your device; we keep only its public part. Keep your device secure: anyone who can
unlock it can sign in as you.
- You're responsible for what happens in your shop.
Using ofsale fairly
- Use ofsale yourself, through its own screens and the tools it offers. Don't use bots, scripts,
crawlers, browser automation or AI agents to access, copy or map it. Accessibility tools such as
screen readers are always fine.
- Don't use ofsale, its screens, its words or the way it works to design, build or train a
product that competes with it, or to copy its look.
- Your own data is always yours to export; this section doesn't limit that.
- If we see automated access, we may slow or pause the shop, and we'll tell you why.
You are the seller
- You decide what you sell and at what price. You're responsible for your pieces, how you
describe them, whether you're allowed to sell them, and for your buyers: pickups, shipping,
returns, refunds and questions.
- You're responsible for any sales tax and other taxes on your sales, and for any licence your
selling needs, unless ofsale has told you in writing that it handles a particular tax for you.
- ofsale is the software you sell with. We aren't a party to your sales.
- Don't sell anything illegal, stolen, counterfeit or recalled, or anything that needs a licence
you don't hold (such as firearms or alcohol). Don't describe a piece in a way you know is
misleading.
Payments
If you take card payments, they go through your own account with a payment provider (such as
Helcim or Stripe), under that provider's own terms. The money goes to your account; ofsale doesn't
hold it.
Booths, stores and marketplaces
- If you also have pieces in a booth at a store or mall, your agreement with that store sets
its commission and rules. ofsale isn't a party to it.
- Commission goes to whoever collects the money for a sale. A sale through a store's register,
website or marketplace account carries that store's commission. A sale through your own Solo shop
or your own marketplace account carries none.
- If you connect a marketplace such as eBay or Etsy, its own terms and fees apply to what you
list there.
Your content and data
- Your photos, descriptions and records stay yours. You let ofsale store, copy, process and show
them as needed to run your shop: your shop page online, your tags and receipts, and any listing
you ask us to make for you.
- Pieces you put on your shop page are public: anyone can see them.
- When you use an AI feature, the photos or words it works on are sent to the AI company that
does the work (such as Google), only for that task.
- We don't use your photos to train AI unless you turn that on separately.
- When you close your shop, we give you an export of your data first.
What we collect when you join
- Your shop's name and, if you give one, your email. The email is used only to send you a
sign-in link if you lose your phone, through Amazon's email service (Amazon SES).
- Your passkey's public part (never its private key).
- Who invited you, or the booth your invitation came from.
- A cookie on the join page (
ofsale_join, kept for a year). We keep a scrambled
copy (a hash) of it, and use it with your email to notice when several free shops are really one
store. It never locks you out of anything.
Your shop runs on ofsale's servers and on Amazon Web Services. What your shop's website collects
from your buyers is described on its own Privacy page.
Invitations
While ofsale is invitation-only, you can invite other people to make their own Solo shop. Only
invite people who'd want to hear from you.
Changes and ending
- We'll tell you in your shop at least 30 days before a change that takes something away from
Solo or adds a charge. If you don't want the change, you can close your shop and take your data
with you.
- You can close your shop at any time.
- Solo is free and in early access. We may end a free shop with 30 days' notice
in the shop, and you get your export first.
- We may suspend or close a shop that breaks these terms, or when the law requires it. Where we
can, we'll tell you first and give you a chance to fix it and to export your data.
No guarantees, and limits
- Solo is free early-access software, provided "as is". We work to keep it running and backed
up, but we can't promise it will never be interrupted or lose data, so keep your own export of
anything important.
- To the extent the law allows, ofsale isn't liable for lost sales, lost profits, or indirect or
consequential losses. Our total liability to you for anything to do with Solo is limited to
$100.
- If someone makes a claim against ofsale because of a piece you sold or how you described it,
you're responsible for that claim.
Law
These terms are governed by the laws of the State of Texas, and any dispute about them is for
the courts in Texas.
